POLICIES and PROCEDURES
Code of Ethics:
As an Independent Representative please recognize that your conduct reflects not only on you, but also on Miracle Travel and other Independent Representatives. You should conduct yourself in such a manner as to reflect only the highest standards of honesty, integrity, and responsibility.
Save Originals Of The Policies And Procedures And Forms To Make Copies As Needed
Paperwork Instructions:
Please make extra copies of the Policies and Procedures, the Questionnaire, and the W-9 form to give to people that buy the Independent Travel Agent Program. Please print carefully on all paperwork. Remember that others have to read it. Give the new applicant a copy of the Policies and Procedures and a copy of the Application. Send the original copy of the Application, the Questionnaire, and the W-9 form to Miracle Travel.
Miracle Travel requires that each Independent Representative (IR) read, understand, and agree to adhere to the following "Policies and Procedures".
Miracle Travel:
Miracle Travel is a travel agency based in Flowood, MS, serving the public and Miracle Travel's IRs.
Independent Representative:
An Independent Representative or ("IR") is any person who has completed a Miracle Travel Independent Representative Application and has been accepted by Miracle Travel. "Person" can refer to a partnership, corporation, trust, or limited liability company (LLC) in which case the rules governing those shall apply.
Independent Contractor:
All Miracle Travel Independent Representatives are independent contractors, responsible for determining their own business activities, and conducting business for their own account. Independent contractors are not employees, partners, agents or joint venturers with Miracle Travel.
As an independent contractor, each IR shall be responsible for obtaining any licenses required by law in their locality. The IR shall be responsible for payment of all income and/or self-employment taxes, Social Security, unemployment, and other taxes.
IRs may not make claims or representations of any kind or communicate in a manner that could lead a reasonable person to assume that they are agents or employees of Miracle Travel. This means, for example, that IRs may not be listed in a phone or Internet directory under the heading of "Miracle Travel." Rather, they may describe themselves as Independent Representatives of Miracle Travel.
IRs may not answer the telephone in any manner that would make callers believe they have reached the corporate offices or any other office of MTN or Miracle Travel.
Legal Age:
An Independent Representative must be at least eighteen (18) years of age.
Exclusive Territories:
Miracle Travel does not grant exclusive territories to any IR.
Income Position:
An Income Position is a person's name and ID# that is placed in Miracle Travel's DATA Entry Tracking Program when that person buys the Independent Travel Agent Program. A person can earn one of these programs by becoming an IR and then referring others that buy a program. The IR will earn an Independent Travel Agent Program after referring 8 people that buy one. After the 8th person buys a program, the IR's Income Position will be activated and placed in that person's group. An IR shall not sell, assign, or transfer any Income Position(s) without the written consent of Miracle Travel. Ownership of an Income Position(s), and all of the rights and responsibilities pertaining thereto, may transfer upon approval by Miracle Travel due to death and legal inheritance.
Additional Income Position(s):
To encourage IRs to help others in their group, an IR may acquire an additional Income Position in Miracle Travel's DATA Entry Program by paying a processing fee of $75 after they have a minimum of 8 people in their group and the approval of Miracle Travel. An IR may have additional Income Positions with the approval of Miracle Travel before acquiring each one. The ID# for the new Income Position(s) will be the same plus 1, 2, 3, etc. (example: 711-1). Any additional Income Position(s) must be placed in the group of someone in the IR's group.
Training Requirements:
Travel Agent training must be completed before an Independent Travel Agent may book any travel. Travel Agent training will vary with different vendors and with different Travel Agent booking engines (most are simple "point & click").
Pay:
Checks will be mailed each month on the 15th for business in the previous month. There will be a $10. check processing fee. Miracle Travel is not responsible for commissions from vendors unless and until they are received at company headquarters.
Presentation Of Miracle Travel's Independent Travel Agent Program:
All IRs must use only information supplied by Miracle Travel when presenting the Independent Travel Agent Program. All IRs are expected to attend a training seminar/workshop presented by a trained representative appointed by Miracle Travel before giving a public presentation. Any presentation given in a public place to prospective IRs must be video and/or audio taped. These tapes must be maintained by the presenter for 36 months and made available to Miracle Travel upon request. Income projections are strictly prohibited. Earnings are determined by individual efforts.
IRs will not imply, state, represent or otherwise infer that Miracle Travel has been endorsed by any person, corporation, business, or government agency (federal, state or local).
IRs are expected to represent and present MTN's home-based business opportunity and compensation plan accurately, fairly, and completely.
Use Of Miracle Travel's Name And Logo:
Miracle Travel employee names, company names, trademarks, logos, brand names, and other intellectual property are the sole property of Miracle Travel. They shall not be used in any manner (including reproduction of literature, or in any advertisement whether printed, recorded or electronic) without written consent of Miracle Travel.
Annual Renewal Fee is $47:
When you buy an Independent Travel Agent Program, the term of the agreement is one year. If you buy an Independent Travel Agent Program in October, November, or December the term of the agreement will be 1 year plus 1, 2, or 3 months. An annual renewal fee is due each year on January 15th. Failure to pay the renewal fee will result in termination after a 10-day grace period.
Cross Selling:
An IR shall not directly or indirectly sell to any other IRs (other than personally referred IRs) non-Miracle Travel products or services. Cross selling is considered grounds for suspension or termination.
Refund Policy:
100% refund if the Independent Representative application and agreement is canceled within 10 days. No refund after 10 days. Cancellation of travel will vary by travel vendor. Also most of the vacation cancellation insurance policies will vary by travel vendor.
Involuntary Termination Of Agreement:
If an IR violates the provisions of the IR application agreement, including provisions of these "Policies and Procedures/Rules and Regulations" at any time, Miracle Travel reserves the right to terminate the IR. This involuntary termination shall be made by Miracle Travel at its sole discretion. Upon termination, the IR agrees to immediately cease all marketing activities and representing himself/herself as an IR of Miracle Travel.
Upon involuntary termination, Miracle Travel will immediately inform the IR in writing. Termination will be effective as dated on the Termination Notice. The notice will be sent by certified mail to the IR's most current address.
The IR will not be entitled to any commissions earned from sales after the date of termination.
Payment of commissions earned by the terminated IR will only be paid for business completed during the last full month prior to termination. A check will be mailed no later than 30 days from the date of termination.
Voluntary Termination of Agreement:
An IR must send a certified letter of resignation to Miracle Travel at their principle address in Flowood, MS. Miracle Travel will not accept a reapplication from an IR who voluntarily resigns for at least 180 days. At that time he or she must begin as an entirely new IR.
Unsolicited E-Mail:
Due to the strong negative connotation associated with unsolicited e-mail on the Internet or other online services which would harm not only the responsible IR but also the reputation of the Company and the entire IR Network, unsolicited e-mail is strictly prohibited. This includes use of commercial e-mail distribution services, e-mail address collection software or similar products, etc. IRs must include their true name and e-mail return address on any e-mails or electronic postings or communications related to their Miracle Travel activities.
Websites And Internet Advertising:
ANY website or ANY advertising MUST have prior written approval of Miracle Travel.
Media Inquires:
To maintain accuracy and a consistent company image, IRs shall not respond to any inquires from any media, whether newspapers, radio, television or other. Such inquires shall be immediately referred directly to the Home Office in Flowood, MS.
Policies And Procedures And Other Amendments
In order to maintain a viable marketing program and to comply with changes in federal, state, and local laws or economic conditions. Miracle Travel reserves the right to amend or modify its Independent Representative Application and Agreement, Policies and Procedures, Compensation Plan, Customer Products and Service Availability and Pricing, and any other of its offerings or terms as it deems appropriate.
Such modifications and amendments will become effective upon publication in official company literature, or any other communication including but not limited to: Notice to the IR through e-mail, the Miracle Travel website, conference calls, or other means. Amendments are incorporated into the agreement between Miracle Travel and the IR, and are effective and binding as of the date of issuance.
Governing Law:
The Application and Agreement, Policies and Procedures, and any other terms and conditions of Miracle Travel shall be governed by the laws of the State of Mississippi.
Indemnification:
Each IR agrees to indemnify and hold harmless Miracle Travel and any parent(s), subsidiary(ies) and/or related organizations, their officers, agents, directors, and employees against any claim, demand, liability, loss, cost or expense, including but not limited to attorney's fees arising or alleged to arise in connection with the IR's Miracle Travel business.
Arbitration:
If a legal dispute should arise between Miracle Travel and any IR, both parties agree to resolve it by arbitration in accordance with the existing rules of the American Arbitration Association. Any arbitration proceedings will be in Flowood, MS.
Miracle Travel MUST have your current email address. The main form of communication from Miracle Travel to all IRs will be email. A correct email address is VERY important!
Independent Travel Agents are NOT allowed to give out passwords to Agent Only Websites or Miracle Travel's vendor information!
